Our Commitment

Qstomize (operated by Green Lunar LLC) respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998, 17 U.S.C. § 512 (the “DMCA”), we will respond expeditiously to claims of copyright infringement involving material uploaded to, transmitted through, or printed on products ordered through Qstomize.com.

Reporting Copyright Infringement

If you are a copyright owner (or authorized to act on behalf of one) and you believe that material on Qstomize.com — including artwork uploaded by a customer for printing — infringes your copyright, please send a written DMCA takedown notice to our designated agent.

To be effective, your notice must include all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed (or a representative list, if multiple works are covered by a single notice).
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, with information reasonably sufficient to permit us to locate the material (such as the order number, product URL, or upload reference).
  4. Your contact information, including your name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner’s behalf.

What Happens After We Receive a Notice

If we receive a notice that substantially complies with the DMCA, we will:

  • Remove or disable access to the allegedly infringing material as soon as reasonably practicable, including pausing or canceling the related production order;
  • Notify the user who uploaded the material that we have removed or disabled access to it; and
  • Forward a copy of the notice to that user.

Please note: under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys’ fees. Don’t send a takedown notice unless you genuinely believe in good faith that the use is unauthorized.

Filing a Counter-Notification

If you are a Qstomize user and your upload, order, or other content has been removed in response to a DMCA notice and you believe in good faith that the removal was the result of mistake or misidentification, you may submit a counter-notification to our designated agent.

To be effective, your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed (e.g., order number or product URL).
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, mailing address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, the U.S. District Court for the District of Delaware), and that you will accept service of process from the person who submitted the original notice or that person’s agent.

If we receive a valid counter-notification, we will forward a copy to the original complaining party. Unless the original complainant files a lawsuit seeking a court order against you within 10–14 business days, we may restore the removed material.

Repeat Infringer Policy

In appropriate circumstances, Qstomize will terminate the accounts of users we determine to be repeat infringers. We may also limit access to Qstomize.com or refuse to print future orders for any user who, in our sole discretion, has infringed the rights of others, regardless of whether the conduct constitutes a repeat offense.
